Now the police have also refused a request by the family for a second post motem examination. If the police have nothing to hide, why refuse a second post mortem?

We demand that those police officers involved be sacked and charged for murder. That the Selangor CPO Datuk Khalid Bakar be sacked from his position for trying to deceive the public that the victim died of breathing difficulties. The the IGP immediately agree to the request of the family of the victim for a second post mortem examination and that there be immediate and comprehensive REFORM of the Malaysian Police force in order to prevent such incidents from recurring.”

6.  Kugan Murder: 11 police personnel assigned to desk duty. Police have, with immediate effect, removed 11 constables and lance corporals from the Subang Taipan police station where the case of A. Kugan, a detainee, who died in their custody, was reclassified as murder yesterday.

Selangor police chief Datuk Khalid Abu Bakar said the policemen were currently at the contingent headquarters here doing desk duties.

“They are here to speed up the investigation. We expect to complete the investigations within three days.

7.  After few merry go round, police final grant permission for second autopsy. The police have finally relented to appeals from the family of Kugan Ananthan to have a second post-mortem to determine his cause of death.

The family of the 22-year-old suspected car thief is disputing the initial official findings which indicate he died due to water in his lungs after five days in police custody.

Lawyer Gobind Singh Deo, who is assisting the family, said the second post-mortem will be done tomorrow at 9am at the University Malaya Medical Centre (UMMC).

“The procedure is expected to take between eight and nine hours because the family has requested for a detailed examination of the body.”

However, he said getting police authorisation for the second post-mortem was an uphill battle despite assurance from Bukit Aman yesterday that the police would authorise it.

Re:Funeral Procession Not a Political Rally.

The statement by the CPO of Selangor Datuk Khalid Abu Bakar concerning the funeral procesion on wed 28 jan 2009 is another abuse of authority by the police calculated to intimidate and dissuade the Malaysian Public from attending the funeral of A.Kugan and to turn the tide of Public Opinion against Police Brutality.

The CPO has a history of distorting and covering up the truth.

In this instance he has gone further to demonise the victim and all Malaysians who wish to see him off in his final journey.

He fails to see the fact that if the police had acted proffessionaly, there would not have been a funeral in the first place.

If the police have a concsience and wish to atone for the sins of their collegues, the least they could do is to ensure the funeral proceeds smoothly without interference by any quarters

The government of the day should be sensitive to aggrieved parties and give them the public space to express their legitimate grievances.

Too many deaths in custody have taken place because the culprits have got away scot- free and the public has largely been complacent.

In this instance, the public sentiment could well see the implementation of concrete measures to put a stop to such atrocities.

Therefore the public not only have a right but a civic duty to attend the funeral and express their empathy for the family and their indignation at such abuses.

Any attempt by the Police to disrupt the peaceful funeral on whatever pretext would only further erode their credibility and that of the ruling government.

Therefore I implore the police to cease and desist from intimidating and provoking peace loving Malaysians who turn up to mourn the death in custody of Kugan.

His family has been put through enough trauma.

I wish to emphasise that the Funeral procession tomorrow will be a peaceful and solemn event in accordance with Hindu Rites and Rituals. The public should not be cowed by irresponsible statements made in the name of “public order”, lest the death of Kugan be in vain.

Therefore ALL MALAYSIANS irrespective of Race, Religion or Creed are invited to pay their last respects to this young man at 2pm on Wednesday, 28 Jan 2009 at the Mortuary of the University Hospital and onward to the cemetry in 14th mile Puchong Road.

18. Crowds mourn Indian who died in Malaysia custody

KUALA LUMPUR, Malaysia – Hundreds of ethnic Indians gathered amid tight security near Malaysia’s largest city Wednesday to mourn a man whose family believes he was killed by police while in custody.

The death last week of 22-year-old Ananthan Kugan has focused attention on accusations of police brutality. Activists say more than 80 detainees _ mainly from the ethnic Indian minority _ have died under questionable circumstances in the past decade.

Kugan died Jan. 20 in a police cell in a suburb near Kuala Lumpur, five days after he was arrested for alleged car theft. Kugan’s family found bruises on his body _ photographs of which have been circulated on the Internet.

Post-mortem results are expected later this week, and authorities have pledged to prosecute policemen involved in any assault. Attorney General Abdul Gani Patail has said the case has been classified as a murder for investigative purposes.

Kugan’s death has become an emotionally charged issue for ethnic Indians, though politicians and activists insist the problem is not one of race, but of justice and police accountability.

Mourners were supposed to stage a funeral march Wednesday to take Kugan’s body from a hospital morgue to a crematorium, but they eventually went in cars because of the long distance.

“If we don’t show our grievances now, then when should we show them? We need to put an end to police brutality,” said S. Jayathas, coordinator of the independent group Police Watch.

Police stood guard as more than 200 people gathered outside the morgue. Many others were prevented by police barricades from coming closer. Witnesses saw police detain five people, some of whom apparently tried to breach the barriers.

More than 300 mourners also stopped briefly at the police station where Kugan died. Some shouted, “We want justice!” and held posters that called the police “killers.”

Ismail Omar, a deputy national police chief, urged the mourners “to remain calm and not be emotional.”

The case has been a further blow to the police force, whose image has long been marred by allegations of corruption and abuse of power.

The police force is dominated by the ethnic Malay majority, which forms nearly two-thirds of the national population. Ethnic Indians comprise about 8 percent of Malaysia’s 27 million people and are among the poorest citizens.

Malaysian Indians have long complained of racial discrimination. Tens of thousands of them staged a rare protest in Kuala Lumpur in November 2007 to demand equal treatment. Police quelled the protest with tear gas and mass arrests. AP NEWS
